1. Short title and extent

Short title and extent.—
- (1) This Act may be called the Bombay Irrigation (Gujarat Extension and Amendment) Act, 1961.
- (2) It extends to the whole of the State of Gujarat.
2. Amendment of Bombay VII of 1879
Statutory text
Amendment of Bombay VII of 1879.— In the Bombay Irrigation Act, 1879, as in force in the State of Gujarat (hereinafter referred to as "the principal Act"), in the long title and the preamble, for the words "State of Bombay" the words "State of Gujarat" shall be substituted.
3. Certain provisions of Bombay VII of 1879 to apply to Saurashtra and Kutch areas

Certain provisions of Bombay VII of 1879 to apply to Saurashtra and Kutch areas. —
- (1) The provisions of the Bombay Irrigation Act, 1879 (Bom. VII of 1879) (hereinafter referred to as "the principal Act") which are in force in the Bombay area of the State of Gujarat shall, save as is otherwise provided in this Act, extend to and be in force in the Saurashtra and Kutch areas of the State.
- (2) Accordingly, the laws specified in the Schedule, in so far as they are in force in the Saurashtra and Kutch areas of the State, shall stand repealed: Provided that such repeal shall not affect—
- (a) the previous operation of any law so repealed or anything duly done or suffered thereunder;
- (b) any right, privilege, obligation or liability acquired, accrued or incurred under any law so repealed;
- (c) any penalty, forfeiture or punishment incurred in respect of any offence committed against any law so repealed; or
- (d) any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid; and any such investigation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed, as if this Act had not been passed.
4. Savings

Savings. —
- (1) Anything done or any action taken (including any appointment or delegation made, notification, order, instruction or direction issued, rule, regulation or form framed, or any canal or work declared, or any rate or fee fixed) under any of the laws repealed by section 3 shall be deemed to have been done or taken under the corresponding provisions of the principal Act and shall continue to be in force accordingly, unless and until superseded by anything done or any action taken under the principal Act.
- (2) Notwithstanding the repeal of the Saurashtra Irrigation Act, 1951 (Sau. Act XI of 1951), the provisions of clauses
- (a) to
- (o) of sub-section
- (1) of section 34 of that Act shall, for the purpose of the adaptation of the principal Act to the Saurashtra area, continue to be in force as if they were a notification issued under section 34 of the principal Act.
5. Repeal of certain laws

Repeal of certain laws.
- (1) On the commencement of this Act, the laws specified in the Schedule shall be repealed to the extent specified in the fourth column thereof: Provided that such repeal shall not affect—
- (a) The previous operation of any law so repealed or anything duly done or suffered thereunder;
- (b) Any right, privilege, obligation or liability acquired, accrued or incurred under any law so repealed;
- (c) Any penalty, forfeiture or punishment incurred in respect of any offence committed against any law so repealed; or
- (d) Any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid, and any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such penalty, forfeiture or punishment may be imposed as if this Act had not been passed: Provided further that, subject to the preceding proviso, anything done or any action taken (including any notification, order, rule, form, notice or scheme made, issued or appointed) under any such repealed law shall, in so far as it is not inconsistent with the provisions of the Bombay Irrigation Act, 1879 (Bom. VII of 1879), as extended by this Act, be deemed to have been done or taken under the corresponding provision of the said Act and shall continue in force accordingly, unless and until superseded by anything done or any action taken under the said Act.
- (2) Nothing in this Act shall be deemed to affect the provisions of the Gujarat Irrigation Act, 1961, as in force in the Saurashtra and Kutch areas of the State of Gujarat.
