The Bombay Irrigation (Gujarat Amendment) Act, 1973

Short title and commencement.—(1) This Act may be called the Bombay Irrigation (Gujarat Amendment) Act, 1973.

1. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

Amendment of section 3 of Bom. VII of 1879.—In section 3 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"),—

1. (1) clause
2. (1) shall be renumbered as clause (1A) and before the clause as so renumbered, the following clause shall be inserted, namely:— "(1) "Agency" means any department of Government, a local authority, or a co-operative society authorized by the State Government in this behalf;";
3. (2) after clause (4), the following clause shall be inserted, namely:— "(4A) "co-operative society" means a society registered or deemed to be registered under the Gujarat Co-operative Societies Act, 1961 (Guj. X of 1962);";
4. (3) after clause (16), the following clause shall be inserted, namely:— "(16A) "water users' association" means a water users' association recognized by the State Government under section 28A;".

Amendment of section 5 of Bom. VII of 1879.—In section 5 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for the words "the State Government may, at any time, by notification in the Official Gazette, direct that any river, stream, natural channel, lake or other natural collection of water shall be applied or used for the purposes of any existing or projected canal," the following shall be substituted, namely:— "the State Government may, at any time, by notification in the Official Gazette, direct that any river, stream, natural channel, lake or other natural collection of water, or any underground water, shall be applied or used for the purposes of any existing or projected canal."

Amendment of section 16 of Bom. VII of 1879.—In section 16 of the Bombay Irrigation Act, 1879, for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 20 of Bom. VII of 1879. — In section 20 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 23 of Bom. VII of 1879. — In section 23 of the principal Act, to the proviso, the following shall be added at the end, namely: — "or

1. (c) by any person with the previous sanction of the Canal-officer incharge of the canal, and in accordance with such terms and conditions as may be prescribed by rules made by the State Government in this behalf."

Amendment of section 29 of Bom. VII of 1879.—In section 29 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for clause (i), the following shall be substituted, namely:—

1. (i) for the construction, improvement, maintenance or repair of any water-course or for the purpose of draining any land;

Amendment of section 31 of Bom. VII of 1879.—In section 31 of the principal Act, for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 35 of Bom. VII of 1879. In section 35 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), in sub-section (1), for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 44 of Bom. VII of 1879.

Amendment of section 45 of Bom. VII of 1879 Amendment of section 45 of Bom. VII of 1879.—In section 45 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 48 of Bom. VII of 1879.—In section 48 of the principal Act, for the words "five hundred rupees" the words "one thousand rupees" shall be substituted.

Amendment of section 54 of Bom. VII of 1879.

Amendment of section 62 of Bom. VII of 1879 Amendment of section 62 of Bom. VII of 1879.—In section 62 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for the word "six" the word "twelve" shall be substituted.

Amendment of section 63 of Bom. VII of 1879.—In section 63 of the principal Act, for the word "six" the word "twelve" shall be substituted.

Amendment of section 64 of Bom. VII of 1879. — In section 64 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), in its application to the State of Gujarat, for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 65 of Bom. VII of 1879. — In section 65 of the principal Act, for the words "fifty rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 66 of Bom. VII of 1879.—In section 66 of the principal Act, for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 67 of Bom. VII of 1879.—In section 67 of the principal Act, for the words "fifty rupees" the words "two hundred and fifty rupees" shall be substituted.

Amendment of section 68 of Bom. VII of 1879.—In section 68 of the principal Act, for the words "local officers" the word "officers" shall be substituted.

Amendment of section 69 of Bom. VII of 1879.—In section 69 of the principal Act, for the words "local officers" the word "officers" shall be substituted.

Amendment of section 70 of Bom. VII of 1879.—In section 70 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 72 of Bom. VII of 1879.—In section 72 of the principal Act, for the words "fifty rupees" the words "two hundred and fifty rupees" shall be substituted.

Amendment of section 73 of Bom. VII of 1879.—In section 73 of the principal Act, for the words "every such canal officer" the words "every such canal officer or any other officer authorised by the State Government in this behalf" shall be substituted.

Amendment of section 75 of Bom. VII of 1879.—In section 75 of the principal Act,—

1. (1) for the words "every canal officer" the words "every canal officer or any other officer authorised by the State Government in this behalf" shall be substituted;
2. (2) for the words "such canal officer" the words "such canal officer or other officer aforesaid" shall be substituted.

Amendment of section 76 of Bom. VII of 1879. — In section 76 of the principal Act, for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 77 of Bom. VII of 1879. — In section 77 of the principal Act, for the words "five hundred rupees" the words "one thousand rupees" shall be substituted.

Amendment of section 80 of Bom. VII of 1879. — In section 80 of the principal Act, for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 82 of Bom. VII of 1879. — In section 82 of the principal Act, for the words "five hundred rupees" the words "one thousand rupees" shall be substituted.

Amendment of section 84 of Bom. VII of 1879.

Amendment of section 86 of Bom. VII of 1879 Amendment of section 86 of Bom. VII of 1879.

Insertion of new section 86A in Bom. VII of 1879 (Insertion of new section 86A in Bom. VII of 1879). In the Bombay Irrigation Act, 1879, after section 86, the following section shall be inserted, namely:— "86A. Power to make rules.

1. (1) The State Government may, by notification in the Official Gazette, make rules to carry out the purposes of sections 85 and 86.
2. (2) All rules made under this section shall be laid for not less than thirty days before the State Legislature as soon as possible after they are made and shall be subject to such modifications as the State Legislature may make during the session in which they are so laid or the session immediately following."

Amendment of section 94 of Bom. VII of 1879 Amendment of section 94 of Bom. VII of 1879. — In section 94 of the principal Act, for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 100 of Bom. VII of 1879. — In section 100 of the principal Act, for the words "five hundred rupees" the words "two thousand rupees" shall be substituted.

Amendment of section 101 of Bom. VII of 1879.—In section 101 of the principal Act, for the word "Collector" wherever it occurs, the word "Officer" shall be substituted.

Amendment of section 102 of Bom. VII of 1879.—In section 102 of the principal Act, for the word "Collector" wherever it occurs, the word "Officer" shall be substituted.

Amendment of section 105 of Bom. VII of 1879.—In section 105 of the Bombay Irrigation Act, 1879 (hereinafter referred to as "the principal Act"), for the words "one hundred rupees" the words "five hundred rupees" shall be substituted.

Amendment of section 106 of Bom. VII of 1879.—In section 106 of the principal Act, for the words "five hundred rupees" the words "one thousand rupees" shall be substituted.

-1 43. Insertion of section 107A in Bom. VII of 1879. — In the Bombay Irrigation Act, 1879, after section 107, the following section shall be inserted, namely: —

Nothing in sections 102, 103, 104, 105, 106 and 107 shall apply to any canal, or any class of canals, which the State Government may, by notification in the Official Gazette, specify in this behalf.
