THE GUJARAT LEGISLATIVE ASSEMBLY PROCEEDINGS (PROTECTION OF PUBLICATION) ACT, 1961.

An Act to protect the p ublication of rep ort s of p roceedings of t he Gujarat Legislative Assembly .

It is hereby enacted in the Twelfth Year of t he Republic of India as follows:-

1. (1) This Act may be called the Gujarat Legislative Assembly Proceedings (Prot ection of Publication) A ct, 1961.
2. (2) It extends to the whole of the State of Gujarat.

In this Act “newsp ap er” means any print ed p eriodical work containing p ublic news or comments on public news, and includes a news-agency supp lying material for publication in a newsp ap er.

(1) Save as ot herwise p rovided in sub-section (2) no p erson shall be liable at any proceedings, civil or criminal, in any Court in respect of the p ublication in a newsp ap er of a substantially true rep ort of any p roceeding of the Gujarat Legislative Assembly , unless the p ublication is p roved to have made with malice. (2) Nothing in sub-section (1) shall be construed as p rot ecting the p ublication of any matter the publication of which is not for the p ublic good.
