The Gujarat Land Acquisition (Industrial Areas) Act, 1961

1. (1) This Act may be called the Gujarat Land Acquisition (Industrial Areas) Act, 1961.
2. (2) It extends to the whole of the State of Gujarat.

In this Act unless the context otherwise requires —

1. (1) "notified area" means any area notified under section 3;
2. (2) "specified date" in relation to a notified area means the 1st day of January 1961.

For the purpose of facilitating the development of industries in the State of Gujarat the State Government may, by notification published in the Official Gazette, notify any area which land in its opinion is suitable or likely to be required for any of the following purposes, that is to say, —

1. (a) the establishment of any industrial or manufacturing unit by the State Government or a Corporation owned or controlled by the State Government;
2. (b) development of land by or for the State Government for the purpose of facilitating the location of industries thereon.

1. (1) Where in a notified area any land is acquired under the Land Acquisition Act, 1894 (hereinafter referred to as "the said Act") or under the Land Acquisition Act, 1894 as applied to the Saurashtra area of the State of Gujarat (hereinafter referred to as "the Saurashtra Act") for any of the purposes specified in the clauses
   • (a) and
   • (b) of section 3 then in relation to such acquisition.
   • (a) the said Act shall have effect as if—
     • (i) in section 11, after the words, figures and brackets "section 4, sub-section (1)" the words, brackets and figures "and at the specified date as defined in the Gujarat Land Acquisition (Industrial Areas) Act, 1961 (hereinafter referred to as "the said specified date")" had been inserted; and
     • (ii) in section 23 in the first clause to sub-section
2. (1) after the words, figures and brackets "section 4, sub-section (1)" the words "or at the said specified date, whichever is less" had been inserted.
   • (b) the Saurashtra Act shall have effect as if—
     • (i) in section 11, after the words, figures and brackets "section 4, sub-section (1)" the words, brackets and figures "and at the specified date as defined in the Gujarat Land Acquisition (Industrial Areas) Act, 1961 (hereinafter referred to as "the said specified date")" had been inserted; and
     • (ii) in section 23 in the first clause of sub-section (1), after the words, figures and brackets "section 4, sub-section (1)" the words "or at the said specified date, whichever is less" had been inserted.
3. (2) Nothing in this section shall apply to any building.

For the removal of doubt it is hereby expressly declared that nothing in this Act shall affect the provisions of the Land Acquisition (Bombay Amendment) Act, 1948, and the Land Acquisition (Bombay Amendment) Act, 1960.
