1. Short title and commencement
Statutory text
Short title and commencement.—(1) This Act may be called the Indian Forest (Goa Amendment) Act, 1988.
- (2) It shall come into force on such date as the Government may, by notification in the Official Gazette, appoint.
2. Amendment of section 2
Statutory text
Amendment of section 2.—In section 2 of the Indian Forest Act, 1927 (Central Act 16 of 1927), as in force in the State of Goa (hereinafter referred to as "the principal Act"),—
- (a) for clause (1), the following clause shall be substituted, namely:— "(1) "tree" includes palms, bamboos, skids, brush-wood and canes;";
- (b) after clause (4), the following clause shall be inserted, namely:— "(4A) "forest officer" means any person whom the Government or any officer empowered by the Government in this behalf, may appoint to carry out all or any of the purposes of this Act or to do anything required by this Act or any rule made thereunder to be done by a forest officer;";
- (c) after clause (7), the following clause shall be inserted, namely:— "(7A) "forest produce" includes,—
- (i) the following whether found in, or brought from, a forest or not, that is to say:— timber, charcoal, caoutchoue, catechu, wood-oil, resin, natural varnish, bark, lac, mahua flowers, mahua seeds, kuth and myrabolams; and
- (ii) the following when found in, or brought from, a forest, that is to say:—
- (a) trees and leaves, flowers and fruits, and all other parts or produce not hereinbefore mentioned, of trees;
- (b) plants not being trees (including grass, creepers, reeds and moss), and all parts or produce of such plants;
- (c) wild animals and skins, tusks, horns, bones, silk, cocoons, honey, and wax, and all other parts or produce of animals; and
- (d) peat, surface soil, rock, and minerals (including limestone and laterite), and all other products of mines or quarries;".
