The Salary and Allowances of the Chief Whip in the Legislative Assembly of the National Capital Territory of Delhi Act, 2003

“THE SALARY ALLOWANCES OF THE CHIEF WHIP IN THE LEGISLATIVEASSEMBLY OF THE NATIONAL CAPITAL TERRITORY OF DELHI ACT 2003 (ACT NO. 5 OF 2003)” [9 th June, 2003] AN ACT to provide for the Salary and Allowances of the Chief Whip of the Majority Party in the Legislative Assembly of the National Capital Territory of Delhi.

BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF THE NATIONAL CAPITAL TERRITORY OF DELHI IN THE FIFTY-FOURTH YEAR OF THE REPUBLIC OF INDIA AS FOLLOWS:-

– (1) This Act may be called the Salary

and Allowances of the Chief Whip in the Legislative Assembly of the National Capital Territory of Delhi Act, 2003.

1. (2) It shall come into force on such date as the Lt. Governor may by notification in the official Gazette, appoint.

– In this Act, unless the context otherwise requires,–

1. (a) “Chief Whip” in relation to the Legislative Assembly of the National Capital Territory of Delhi means that Member of the Legislative Assembly who is, for the time being, declared by the majority party to be the Chief Whip in that House of the party forming the Government and recognized as such by the Speaker of the Legislative Assembly;
2. (b) “Speaker” means the Speaker of the Legislative Assembly of the National Capital territory of Delhi.

– (1) The Chief Whip shall be

entitled to receive a salary, constituency allowance and daily allowance at the

Act, 1994 (Delhi Act No. 8 of 1995).

1. (2) The Chief Whip shall be entitled to receive sumptuary allowance at the same rate as is admissible to a Minister under the Ministers of the Government

of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994

(Delhi Act No.8 of 1995).

1. (3) The Chief Whip shall also be paid such conveyance allowances, travelli- ng allowances and daily allowances for tour outside Delhi and shall be entitled to such amenities regarding residence or compensatory allowance in lieu thereof and use of motor car, as are admissible to a Minister under the

Ministers of the Government of the National Capital Territory of Delhi (Salaries

and Allowances) Act, 1994 (Delhi Act No. 8 of 1995). Provided that the Chief Whip shall not be entitled to any travelling allowance in case the journey is performed by him in a free official transport. th June, 2003, see Notification No. 14 (11) 97-LAD dated 9 th June, 2003, Delhi state Gazette part IV.

–The Chief Whip and members of his

family shall be entitled to such medical facilities on similar terms as provided to

a Minister under the Ministers of the Government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994 (Delhi Act No. 8 of 1995).

– The Chief Whip shall be entitled to such telephone facilities as are admissible to a Minister under the Ministers of the Government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994 (Delhi Act No. 8 of 1995).

Assembly.–– The Chief Whip shall not be entitled to receive any sum by way of

salary or allowances as a Member of Legislative Assembly except what is

specifically provided for by this Act.

person became, or ceased to be, Chief Whip shall be published in the official

Gazette, and any such notification shall be conclusive evidence of the fact that he became, or ceased to be, the Chief Whip on that date for all purposes of this

Amendment of Delhi Act No. 6 of 1995.–– In the Members of Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension, etc.) Act, 1994.

1. (i) in clause (f) of section 2.

1. (a) in sub-clause (ii), the word “and” at the end shall be omitted and added at the end of sub-clause (iii).
2. (b) After sub-clause (iii), the following sub-clause shall be inserted, namely. “(iv) The Chief Whip as defined in the Salary and Allowances of the Chief Whip in the Legislative Assembly of the National Capital Territory of Delhi Act, 2003.”;
   • (ii) in sub-section (4) of section 9, after the words “Leader of Opposition as

defined in the Leader of Opposition in the Legislative Assembly of the National

Amendment of Delhi Act No. 6 of 1997.–– In the Delhi Members of the Legislative Assembly (Removal of Disqualification) Act, 1997, in the schedule, after the entry at serial number 3, following new entry shall be inserted, namely:–

“4. The office of the Chief Whip in the Legislative Assembly of the National

Capital Territory of Delhi. Explanation.–– The expression “Chief Whip” shall have the meaning assigned to it in the Salary and Allowances of the Chief Whip in the Legislative Assembly of the National Capital Territory of Delhi Act, 2003.”
