The Chhattisgarh Tractor Dwara Kheti Prabharon Ki Vasuli Adhiniyam, 1972

(1) This Act may be called the Chhattisgarh Tractor Dwara Kheti Prabharon Ki Vasuli Adhiniyam, 1972. (2) It extends to the whole of Chhattisgarh. (3) It shall come into force on such date as the State Government may, by notification, appoint. In exercise of the powers conferred by section 7 of the Madhya Pradesh Tractor Dwara Kheti Prabharon Ki Vasuli Adhiniyam, 1972 (No. 9 of 1973), the State Govt. hereby makes the following rules, namely: In these rules, unless the context otherwise requires,- (a) "form" means a form appended to these rules; and (b) "section" means a section of the Madhya Pradesh Tractor Dwara Kheti (Prabharon Ki Vasuli) Adhiniyam, 1972 (No. 9 of 1973).

In this Act, unless the context otherwise requires,— (a) "Cultivator" means a person holding land for the purpose of cultivation in any capacity and includes any person who holds land from Government or a tenure holder as a sub-tenant or lessee; (b) "Prescribed" means prescribed by rules made under this Act; (c) "State Government" means the Government of Madhya Pradesh. In these rules, unless the context otherwise requires,— (a) "Form" means a form appended to these rules; and (b) "Section" means a section of the Madhya Pradesh Tractor Dwara Kheti Prabharon Ki Vasuli Adhiniyam, 1972 (No. 9 of 1973).

Notwithstanding anything contained in any law for the time being in force, where the State Government has provided or provides tractor service for the cultivation of any land of a cultivator, the charges for such service as determined by the State Government shall be recoverable from the cultivator as if it were an arrear of land revenue and shall be credited to the State Government. The application under sub-section (1) of section 3 for tractor cultivation shall be in Form I and shall be accompanied by a certificate from Patwari concerned to the effect that the applicant is a Bhumiswami or holder of the land in question. The application under sub-section (1) of section 3 for tractor cultivation shall be in Form I and shall be accompanied by a certificate from Patwari concerned to the effect that the land is in a bhumiswami holder of the land in question.

(1) The State Government may make rules for carrying out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely— (a) the manner in which the charges shall be determined; (b) the terms and conditions on which the tractor service shall be provided; (c) any other matter which is to be or may be prescribed. (3) All rules made under this Act shall be laid on the table of the Legislative Assembly. An intimation of acceptance of the application made under sub-section (1) of section 3 for tractor cultivation shall be communicated to the cultivator concerned in Form II.

The Madhya Pradesh Tractor Dwara Kheti Prabharon ki Vasuli Adhyadesh, 1972 (No. 6 of 1972) is hereby repealed. The bond to be executed under sub-section (2) of section 4 shall be in Form III.

In exercise of the powers conferred by section 7 of the Madhya Pradesh Tractor Dwara Kheti (Prabharon Ki Vasuli) Adhiniyam, 1972 (No. 9 of 1973), the State Government hereby makes the following further amendment in the Madhya Pradesh Tractor Dwara Kheti (Prabharon Ki Vasuli) Niyam, 1981, namely: 1. Scale of Tractor Cultivation Charges: The scale of tractor cultivation charges shall be as under: (i) Tractor of 40 horsepower or above: Rs. 325/- per hour; (ii) Tractor of 40 horsepower or above: Rs. 50/- per kilometer (for to and fro). This amendment shall come into force with effect of August, 2008.
