The Madhya Pradesh Temporary Postponement of Execution of Decrees Act, 1958
1. Short title, extent and commencement
(1) This Act may be called the Madhya Pradesh Temporary Postponement of Execution of Decrees Act, 1958. (2) It extends to the whole of the State of Madhya Pradesh. (3) It shall come into force on such date as the State Government may, by notification, appoint.
2. Definitions
In this Act, unless the context otherwise requires,- (a) "Agriculturist" means a person who earns his livelihood wholly or mainly from agriculture or who personally cultivates land; (b) "Civil Court" means a court performing the functions of a civil court under the Code of Civil Procedure, 1908 (V of 1908); (c) "Decree for money" means a decree for the payment of money passed by a civil court in a suit relating to any debt or liability arising out of a loan or credit transaction.
3. Postponement of execution of decree
Notwithstanding anything contained in the Code of Civil Procedure, 1908 (V of 1908), or any other law for the time being in force, all proceedings in execution of a decree for money passed by a civil court against an agriculturist, which are pending on the date of the commencement of this Act or which may be instituted thereafter, shall be postponed for a period of one year from the date of such commencement.
