1. Short title and commencement

Short title and commencement. —
- (1) This Act may be called the Chhattisgarh Protection of Primitive Tribes (Interest in Trees) (Amendment) Act, 2017.
- (2) It shall come into force from the date of its publication in the Official Gazette.
2. Amendment of Section 4
Statutory text
Amendment of Section 4. — In the Chhattisgarh Protection of Primitive Tribes (Interest in Trees) Act, 1956 (No. 11 of 1956), in Section 4, for sub-section (1), the following shall be substituted, namely: —
- (1) Notwithstanding anything contained in the Indian Forest Act, 1927 (No. 16 of 1927) or the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959) or any other law for the time being in force, no member of a primitive tribe shall sell, or contract to sell, his interest in any tree standing on his land or timber thereof, to any person other than the State Government or an officer or agent authorized by the State Government in this behalf: Provided that the member of a primitive tribe may, with the prior written permission of the Collector, sell his interest in any tree or timber thereof to any other person for domestic use or marriage or funeral purpose: Provided further that the sale of trees for any purpose as referred to in the first proviso shall be subject to the rules made in this behalf by the State Government.
