The Chhattisgarh Mantri (Vetan tatha Bhatta) (Sanshodhan) Adhiniyam, 2001
1. Amendment to Rules
In the above rule :- (1) Rule 3 (1-AA), shall be omitted. (2) In the Rule-3 (1-AAA) words "sub-section 2 of section 5-B" shall be omitted and "5-A" shall be substituted. (3) First proviso of Rule 3 (1-AAA) shall be omitted and following proviso shall be substituted; "Provided that the total expenditure on a journey performed by a members by rail and the three journey performed by air, under Section 5-A shall not exceed the amount Rupees Seventy Five Thousand in a financial year." (4) In the Rule 3 (1-AAA) (iii) words "Sub-section 2 of Secion 5-B" shall be omitted and "5-A" shall be substituted. (5) Rule 3 (1 B) shall be omitted. (6) Rule 3 (1 C) shall be omitted. (7) Rule 3 (2) shall be omitted. (8) In the Rule 3 (3) words "and he shall also be entitled to daily allowance at the rate of Rupees (two) hundred per day for staying at such place" shall be omitted. (9) Proviso of Rule 3 (3) shall be omitted. (10) Rule 4 (1) and sub-clause (a) (b) shall be omitted. (11) Rule 4 (2) shall be omitted. (12) Rule 5 (1) shall be omitted. (13) In the Rule 5 (2) words "and if he stays at the place of the meeting, he shall be entitled to daily allowance for all days of halt not exceeding seven" shall be omitted. (14) Rule 5 (4) shall be omitted. (15) In the Rule 8 (1) word "or daily allowance" shall be omitted. (16) In the Rule 8 (3) word "and daily allowance" shall be omitted. 2. Extent and commencement
This amendment shall come into force in the whole of Chhattisgarh State from the date of receiving assent of the Governor of Chhattisgarh.
3. Insertion of new sections 4-A and 4-B
After section 4-ka of the Principal Act, the following sections shall be inserted, namely:-- "4-kh Ardali Bhatta:-- Every member shall be given Ardali allowance at the rate of Rs. 1,000 per month. 4-ga Dainik Bhatta:-- Every member shall be given daily allowance at the rate of Rs. 300."
4. Omission of section 5-ka and substitution of new section
Section 5-ka of the Principal Act shall be omitted and the following section shall be substituted:-- "5-ka Vayuyan aur Rail dwara निःshulk Abhivahan:-- (1) Every member, subject to such rules as may be framed by the State Government in this behalf, shall be entitled to free rail and air travel within Bhartiya varsh, and the expenditure on such travel in a financial year shall not exceed Rs. 75,000, Provided that, every member shall be entitled to only three return air journeys. Provided further that, every member shall be entitled to travel with one other person during rail travel. Provided further that, the journeys made by members for attending the meetings of committees shall remain outside the financial limit mentioned in this sub-section. (2) Every person entitled to pension under section 6-ka shall, subject to such rules as may be framed by the State Government in this behalf, be entitled to coupon worth Rs. 40,000 for travel in a financial year, either alone or with one other person."
5. Amendment of rule 7
Certificate explains in the rule 7 shall be omitted and following "I hereby certify that Shri/Shrimati/Kumari............. is the member of the Chhattisgarh Legislative Assembly, and First Class/Air Condition, Sleeper, Second Class/Air Condition, Sleeper three tier/Second Class Sleeper tickets may be issued in exchange of the rail travelling coupon for the journey to be under taken by him/her and for the journey under taken by one person accompanying him/her within the State of Chhattisgarh and outside the State of Chhattisgarh only to the extent of Rs. 75,000/- (Rs. 6. Omission of section 6 and substitution of new section
Section 6 of the Principal Act shall be omitted and the following section shall be substituted:-- "Section 6-Yatra Bhatta:-- Every member shall be given travelling allowance, at such rates as may be prescribed, for every such journey made by him or her for the purpose of attending a session or a meeting of a committee, either within the State or outside the State, from his or her primary residence to the place where he or she is required to attend the session or meeting, and for the return journey from such place to his or her primary residence."
7. Deletion of rule 9 (1) (b)
Rule 9 (1) (b) shall be omitted.
8. Amendment of Rule 3(3)
In Rule 3 (3), the words "and daily allowance at the rate of Rs. 200 per day for stay at such place" shall be omitted.
9. Amendment to Rule 3(3) proviso
The proviso to Rule 3 (3) shall be omitted.
10. Amendment of Rule 4(1)
Rule 4 (1) and its sub-clauses (ka) and (kha) shall be omitted.
11. Amendment of Rule 4(2)
Rule 4 (2) shall be omitted.
12. Amendment of Rule 5(1)
Rule 5 (1) shall be omitted.
13. Amendment of Rule 5(2)
In Rule 5 (2), the words "and if he stays at the place of conference, he shall be entitled to daily allowance for the period not exceeding 7 days of the total days of stay" shall be omitted.
14. Amendment of Rule 5(4)
Rule 5 (4) shall be omitted.
15. Amendment of Rule 8(1)
In Rule 8 (1), the word "Daily Allowance" shall be omitted.
16. Amendment of Rule 8(3)
In Rule 8 (3), the words "and daily allowance" shall be omitted.
17. Certificate Amendment in Rule 7
Certificate explains in the rule 7 shall be omitted and following "I hereby certify that Shri/ShrimatiKumari............. is the Ex-member of the Chhattisgarh Legislative Assembly, and First Class/Air Condition, Sleeper, Second Class/Air Condition Sleeper three tier/Second Class Sleeper tickets may be issued in exchange of the rail travelling coupon for the journey to be under taken by him/her and for the journey under taken by one person accompanying him/her within the State of Chhattisgarh and outside the State of Chhattisgarh only to the extent of Rs. 40,000/- (Rs. forty thousand) per year." shall be substituted.
18. Amendment of Rule 9(1)(a)
Rule 9 (1) (a) shall be omitted and "Coupon book shall be issued at a time to member valued Rs. 5,000/- (Rs. five thousand)" shall be substituted.
19. Amendment of Rule 9(1)(b)
Rule 9 (1) (b) shall be omitted.
20. Amendment of Rule 11
Rule 11 (1, 2, 3) shall be omitted.
Notification 1. Amendment to Schedule II
No. 1882/F-10/324/2001/CT/V (45).—In exercise of the powers conferred by Sub-section (1) of Section 16 of the Chhattisgarh Vanijyik Kar Adhiniyam, 1994 (No. 5 of 1995), the State Government hereby makes the following amendment in schedule II of the said Adhiniyam, the same having been previously published in Chhattisgarh Gazette vide this Department Notification No. 1797/F-10/324/2001/CT/V (44), dated 27-8-2001 as required by the proviso of the said Sub-section namely:— AMENDMENT In the Schedule II of the said Adhiniyam :— In part III, after serial number 54, the following serial number and entry relating thereto shall be inserted, namely :— 55 All kinds of gases including liquified gases except those specified elsewhere in the schedule 12.
Notification 2. Rescinding of Notifications
No. 1884/F-10/324/2001/CT/V (46).—In exercise of the powers conferred by Section 17 of Chhattisgarh Vanijyik Kar Adhiniyam, 1994 (No. 5 of 1995), the State Government hereby rescind the following notification of this department with effect from 1 September 2001 namely:— 1. Notification No. A-3-10-2000-ST- V (53), dated 26th July, 2000. 2. Notification No. F-10/153/2001-CT-V (24), dated 4th June, 2001
Rule 3. Substitution of a new clause
Rule 3 shall be omitted and new clause-3 "Subject to the provisions of the Act and these rules, every Ex-members shall be provided by the Secretary with sets of coupon books, which shall entitle him and any person accompanying him to travel within India by Rail value upto rupees 40,000/- (Rs. forty thousnad)" shall be substituted.
Rule 4 (1). Amendment regarding Railway station
In the rule 4 (1) words "Central Railway Bombay" shall be omitted and "South Eastern Railway Howarah" shall be substituted.
Rule 4 (2). Amendment regarding Railway station
In the rule 4 (2) words "Central Railway Bombay" shall be omitted and "South Eastern Railway Howarah" shall be substituted.
Rule 5 (1). Substitution of money value coupon books
In the rule 5 (1) description of money value coupon books shall be omitted and following :-- (1) 8 Coupons of Rs. 100 each Rs. 800.00; 12 Coupons of Rs. 50 each Rs. 600.00; 12 Coupons of Rs. 25 each Rs. 300.00; 20 Coupons of Rs. 10 each Rs. 200.00; 15 Coupons of Rs. 5 each Rs. 80.00; 20 Coupons of Rs. 1 each Rs. 20.00; Total Rs. 2000.00. (2) 8 Coupons of Rs. 50 each Rs. 400.00; 12 Coupons of Rs. 15 each Rs. 300.00; 20 Coupons of Rs. 10 each Rs. 200.00; 16 Coupons of Rs. 5 each Rs. 80.00; 20 Coupons of Rs. 1 each Rs. 20.00; Total Rs. 1000.00. (3) 4 Coupons of Rs. 50 each Rs. 200.00; 8 Coupons of Rs. 25 each Rs. 200.00; 4 Coupons of Rs. 10 each Rs. 40.00; 8 Coupons of Rs. 5 each Rs. 40.00; 20 Coupons of Rs. 1 each Rs. 20.00; Total Rs. 500.00. Shall be substituted.
Rule 7. Substitution of certificate format
Rule 7 shall be omitted and new format "I hereby certify that Shri/Smt/Ku. ..................................... are/is Member of Chhattisgarh Vidhan Sabha, and is entitled to undertake journey within and outside the Chhattisgarh State upto the value of Rs. 40,000/- (Rupees Forty Thousand) per annum by Railway and to receive First Class/A.C. Sleeper II Class/A.C. Sleeper III Class/II Class Sleeper tickets in exchange of Railway Travel Coupons for himself/herself and one person accompanying him/her" shall be substituted.
Rule 9 (1) (k). Amendment
Rule 9 (1) (k) shall be omitted and in its place "each member shall be issued coupon books worth Rs. 5,000 (Rupees five thousand) at one time" shall be substituted.
Rule 9 (1) (g). Deletion
Rule 9 (1) (g) omitted.
Rule 11. Deletion of sub-rules
Rule 11 (Sub rule one, two and three) omitted.
