The Chhattisgarh Labor Law Amendment and Miscellaneous Provisions Act, 2025
1. Short title, extent and commencement
- (1) This Act may be called the Chhattisgarh Labour Laws Amendment and Miscellaneous Provisions Act, 2025.
- (2) It extends to the whole State of Chhattisgarh.
- (3) It shall come into force from the date of its publications in the Official Gazette.
2. Amendment of Section 92
In the Factories Act, 1948 (No. 63 of 1948), (hereinafter referred to as the Principle Act), in Section 92, after the word “thereunder” and before the word and the punctuation “, the occupier”, the words and figure “(except Section 6 or of any rules made thereunder)” shall be inserted.
3. Insertion of Section 92A and 92B
After Section 92 of the Principle Act, the following Section shall be added, namely:—
"92A. Compounding of offences.—
- (1) The State Government may, by notification in the Official Gazette, prescribe compounding fee in respect of the offences specified in the Fourth Schedule which shall not be more than the fine specified under Section 92, and the Chief Inspector or the Inspector may compound such offence before or after institution of the prosecution for such amount: Provided that, the offence to be compounded does not involve any contravention of any of the provisions of this Act or of any rules made thereunder resulting in an accident causing death or serious bodily injury or dangerous occurrence.
- (2) Where an offence has been compounded under sub-section (1),—
- (i) before the institution of the prosecution, the offender shall not be liable to prosecution in respect of such offence;
- (ii) after the institution of the prosecution, such compounding shall be brought by the Chief Inspector or the Inspector in writing, to the notice of the court in which the prosecution is pending and on such notice of the compounding of offence being given, the offender shall be acquitted.
92B. Fine for violation of Section 6.
Save as otherwise expressly provided in this Act and subject to the provisions of Section 93, if in, or in respect of, any factory there is any contravention of Section 6 of this Act or of any rules made thereunder or of any order in writing given thereunder, the occupier of the factory shall be guilty of an offence and punishable with a fine which shall not be less than two lakh rupees but which may extend up to three lakh rupees, and if the contravention is continued after the conviction, then, with further fine which may extend to two thousand rupees for each day till such contravention continues."
4. Amendment of Section 106 In Section 106 of the Principle Act for the words "three months" the words "six months" shall be substituted.
5. Insertion of Schedule After the Third Schedule appended to the Principle Act, the following Schedule shall be inserted, namely :—
