The Chhattisgarh Jan Vishwas (Amendment of Provisions) (Second) Act, 2025(See Section 2) No. Amendment (1) (2) 1. In the Chhattisgarh Value Added Tax Act, 2005 (No. 2 of 2005), (1) In para (a) of sub-clause (i) below clause (k) of sub-section (1) of Section 64, for the words “imprisonment which may extend to six months and a fine” and “two”, the words “penalty” and “ten” shall be substituted, respectively. (2) In para (b) of sub-clause (i) below clause (k) of sub-section (1) of Section 64, for the words “imprisonment which may extend to six months and a fine” and “two”, the words “penalty” and “ten” shall be substituted, respectively. (3) In sub-clause (ii) below clause (k) of sub-section (1) of Section 64, for the words “imprisonment which may extend to three months or a fine” and “one”, the words “penalty”, and “five” shall be substituted, respectively. (4) In sub-clause (ii) below clause (k) of sub-section (1) of Section 64, for the word “or both” shall be omitted. (5) In sub-clause (ii) below clause (k) of sub-section (1) of Section 64, for the word “fine”, wherever it occurs, the word “penalty” shall be substituted. (6) In sub-section (2) of Section 64, the following proviso shall be added, namely,- “ Provided that the Commisioner may imposed penalty, as per sub-section (1), after giving the contravener a reasonable opportunity of hearing.” 2. In the Chhattisgarh Cinemas (Regulation) Act, 1952 (No. 17 of 1952), In Section 7, for the words “one thousand”, “fine” and “one hundred”, the words “five thousand, “penalty” and “five hundred” shall be substituted, respectively. 3. In the Chhattisgarh Rajim Kumbh Mela Act, 2006 (No. 22 of 2006), In Section 10, for the words “shall be punished on conviction with simple imprisonment which may extend to three months or with fine which may extend to one thousand rupees or with both and where the offence is a continuing or recurring one with a further fine which may extend to Rs. 100 (Rs. hundred only) for every day after the date of the first conviction during which the offender is proved to have persisted in such offence”, the words “for the first offence, shall be punishable with a penalty of Five thousand rupees and for second offence, to a penalty of Ten thousand rupees and for third or further continuous offence, to simple imprisonment for a term which may extend to three months, or to a fine which may extend to Ten thousand rupees, or both” shall be substituted. 4. In the Chhattisgarh Fisheries Act, 1948 (No. 8 of 1948), In Section 5, for the words “on convication be punishable with imprisonment for a term which may extend to one year or with fine which may extend to ten thousand rupees, or with both” the words “be liable for penalty which may extend to twenty-five thousand rupees” shall be substituted. 5. In the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 (No. 21 of 2018), (1) In sub-section (1) of Section 20, for the words “punishable with fine” and “fine”, the words “liable for penalty” and “penalty” shall be substituted, respectively. (2) In proviso of sub-section (1) of Section 20, for the word “fine”, the word “penalty” shall be substituted. (3) In sub-section (1) of Section 22, for the words “punishable with fine”, the words “liable for penalty” shall be substituted. (4) In sub-section (2) of Section 22, for the words “punishable with fine” and “fine”, the words “liable for penalty” and “penalty” shall be substituted, respectively. (5) In proviso of sub-section (2) of Section 22, for the word “fine”, the word “penalty” shall be substituted. 6. In the Chhattisgarh Shram Kalyan Nidhi Adhiniyam, 1982 (No. 36 of 1983), (1) In clause (a) of sub-section (1) of Section 31, for the words, “imprisonment for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both”, the words “penalty which may extend to ten thousand rupees,” shall be substituted. (2) In clause (b) of sub-section (1) of Section 31, for the word “one”, the word “twenty” shall be substituted. (3) In proviso of sub-section (1) of Section 31, for the word “one hundred”, the word “ten thousand” shall be substituted. (4) In sub-section (2) of Section 31, for the words “punishable with imprisonment for a term which may extend to one year, or with fine which may extend to two thousand rupees, or with both”, the words “liable for a penalty of ten thousand rupees for the first offence and, for the subsequent offence imprisonment for a term which may extend to one year, or with fine which may extend to fifteen thousand rupees, or with both” shall be substituted. 7. In the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), (1) In sub-section (3-A) of Section 55, for the words “punished with simple imprisonment which may extend to six months or with fine which may extend to two thousand rupees or with both, and in case of continuing offense with further fine which may extend to two hundred and fifty rupees for every day during which the offense continued after the date of first conviction”, the words “liable for penalty which may extend to ten thousand rupees in case of first offence and in case of second offence, liable for penalty which may extend to twenty thousand rupees and in case of continuing offence, he shall be punished with simple imprisonment which may extend to six months, or with minimum fine of twenty thousand rupees, or with both” shall be substituted. (2) In sub-section (1) of Section 56, for the words, “fine”, “one thousand” and “twenty”, the words “penalty”, “five thousand” and “one hundred” shall be substituted, respectively. (3) In sub-section (1) of Section 60, for the words “fine” and “one”, the words “penalty” and “five” shall be substituted, respectively. (4) In sub-section (3) of Section 61-D, for the words “punished with simple imprisonment which may extend to six months or with a minimum fine of ten thousand rupees or with both”, the words “liable for penalty which may extend to fifty thousand rupees and in case of continuing offence, he shall be punished with simple imprisonment which may extend to six months or with a minimum fine of fifty thousand rupees or with both” shall be substituted. (5) In sub-section (5) of Section 61-D, for the words “punished with simple imprisonment which may extend to six months or with a minimum fine of one thousand rupees or with both”, the words “liable for a penalty of five thousand rupees and in case of continuing offence, he shall be punished with simple imprisonment which may extend to six months or with a minimum fine of five thousand rupees or with both.” shall be substituted. (6) In Section 61-E, for the words “simple imprisonment which may extend to six months or with fine or with both”, the words “liable for penalty of ten thousand rupees and in case of second offence, he shall be liable for penalty of twenty thousand rupees, further in case of continuing offence he shall be punished with simple imprisonment which may extend to six months or with fine of twenty thousand rupees or with both” shall be substituted. (7) In sub-section (5) of Section 95, for the words “two hundred fifty”, “five” and “conviction”, the words “two thousand”, “one hundred” and “breach” shall be substituted, respectively. (8) In sub-section (5) of Section 95, for the word “fine”, wherever it occurs, the word “penalty” shall be substituted. (9) In sub-section (2) of Section 96, for the words “two hundred fifty”, “conviction” and “five”, the words “two thousand”, “offence” and “one hundred” shall be substituted, respectively. (10) In sub-section (2) of Section 96, for the word “fine”, wherever it occurs, the word “penalty” shall be substituted. (11) In sub-section (1) of Section 98, the words “on conviction” shall be omitted. (12) In sub-section (1) of Section 98, for the words “fine” and “fifty”, the words “penalty” and “five hundred” shall be substituted, respectively. (13) In sub-section (2) of Section 98, the words and symbols “, on conviction,” shall be omitted. (14) In sub-section (2) of Section 98, for the words “fine” and “one”, the words “penalty” and “five” shall be substituted, respectively. (15) In sub-section (3) of Section 98, for the words “fine” and “two”, the words “penalty” and “ten” shall be substituted, respectively. (16) In Section 99, the words and symbols “, on conviction,” shall be omitted. (17) In Section 99, for the words “fine” and “two hundred fifty”, the words “penalty” and “two thousand” shall be substituted, respectively. (18) In Section 102, the words “on conviction” shall be omitted. (19) In Section 102, for the words “fine” and “two hundred fifty”, the words “penalty” and “two thousand” shall be substituted respectively. (20) In Section 103, the words “on conviction” shall be omitted. (21) In Section 103, for the words “fine” and “fifty”, the words “penalty” and “two hundred fifty” shall be substituted respectively. (22) In Section 104, the words and symbols “, on conviction,” shall be omitted. (23) In Section 104, for the words “fine” and “two hundred fifty”, the words “penalty” and “two thousand” shall be substituted, respectively. (24) In sub-section (2) of Section 105, the words and symbol “on conviction,” shall be omitted. (25) In sub-section (2) of Section 105, for the words “fine” and “two hundred fifty”, the words “penalty” and “two thousand” shall be substituted, respectively. 8. In the Chhattisgarh Griha Nirman Mandal Adhiniyam, 1972 (No. 3 of 1972), (1) In Section 77, for the words “imprisonment for a term which may extend to three months or with fine which may extend to one thousand rupees or with both”, the words “penalty of five thousand rupees for the first offence, in the case of continuing offence, with simple imprisonment which may extend to three months or with fine of ten thousand rupees or with both” shall be substituted. (2) In Section 78, for the clauses (a) and (b), the following clauses shall be substituted, namely – “(a) for the first offence with penalty of five thousand rupees, (b) for second offence with imprisonment for a term which may extend to three months or with fine of ten thousand rupees, or with both; (c) in case of a continuing contravention, with fine, which may extend to five hundred rupees for each day after the first contravention, during which the contravention continues.” 9. In the Chhattisgarh Irrigation Act, 1931 (No. 3 of 1931), (1) In sub-section (2) of Section 75-F, for the words “imprisonment which may extend to six months or with fine which may extend to one thousand rupees or with both.” the words “penalty which may extend to twenty-five thousand rupees” shall be substituted. (2) In sub-section (5) of Section 92, for the words “two hundred and fifty” and “ten”, the words “one thousand” and “fifty” shall be substituted, respectively. (3) In sub-section (5) of Section 92, for the word “fine”, wherever it occurs, the word “penalty” shall be substituted. (4) In clause (i) of Section 94, for the words “(a) to (h)” and “twenty”, the words “(a) to (c)” and “two hundred” shall be substituted, respectively. (5) In clause (ii) of Section 94, for the words “(i) to (l)”, “hundred”, and “imprisonment which may extend to one month”, the words “(d) to (l)”, “thousand”, and “penalty of five thousand rupees” shall be substituted, respectively. (6) In sub-section (6) of Section 99, for the words “two hundred and fifty”, the words “one thousand” shall be substituted. 10. In the Chhattisgarh Sinchai Prabandhan Me Krishkon Ki Bhagidari Adhiniyam, 2006 (No. 20 of 2006), (1) In the clause (i) of Section 39, for the words “imprisonment which may extend to two years, or with fine which shall not be less than one thousand Rupees but which may extend to five thousand Rupees or with both; and when the offence is a continuing one with an additional fine not exceeding twenty rupees for every day”, the words “penalty of Ten Thousand rupees for the first offence, and for the second offence with imprisonment which may extend to six months, or with fine of Twenty-five thousand rupees or with both; and for continuing offence with an additional fine not exceeding hundred rupees for every day” shall be substituted, respectively. (2) In the clause (ii) of Section 39, for the words “fine”, “five hundred”, “two thousand” and “six months”, the words “penalty”, “Two thousand”, “ten thousand” and “one month” shall be substituted, respectively. 11. In the Chhattisgarh Ground Water (Management and Regulation) Act, 2022 (No. 18 of 2022), (1) In sub-section (1) of Section 19, for the words “imprisonment for a term not less than three months which may extend to one year and fine which shall not be less than five thousand rupees but which may extend to Ten thousand rupees”, the words “penalty which may extend to Twenty-five thousand rupees but not less than Ten thousand rupees” shall be substituted. (2) In the proviso of sub-section (1) of Section 19, for the words “Ten thousand rupees” and “fifteen thousand rupees”, the words “Twenty-five thousand rupees” and “Fifty thousand rupees” shall be substituted, respectively. (3) For sub-section (2) of Section 19, the following shall be substituted, namely:- “(2) Notwithstanding anything contained in sub-section (1), if the offence described in clause (a), clause (b), clause (c) or clause (d) is committed by any commercial user, industrial user, infrastructural user or any bulk user he shall be punishable with imprisonment for a term which shall not be less than three months but which may extend to one year with fine which shall not be less than twenty five thousand rupees but may extend to fifty thousand rupees: Provided that when any person is convicted under this Section for an offence for second or subsequent time, he shall be punishable for every such offence with imprisonment for a term which shall not be less than six months but which may extend to two years and with fine which shall not be less than fifty thousand rupees but may extend to one lakh rupees.” 12. In the Chhattisgarh Primary Education Act, 1961 (No. 33 of 1961), (1) Section 22 shall be omitted. (2) Section 23 shall be omitted. 13. In the Chhattisgarh Rajmarg Act, 2003 (No. 12 of 2003), (1) In sub-clause (iii) of clause (g) of sub-section (2) of Section 7, for the words “fine”, “5000” and “1000”, the word “penalty”, “ten thousand rupees” and “two thousand rupees” shall be substituted, respectively. (2) In Section 53, the words and symbols “, on conviction,” shall be omitted. (3) In Section 53, for the words “fine” and “two”, the words “penalty” and “ten” shall be substituted, respectively. (4) In Section 54, the words “on conviction” shall be omitted. (5) In clause (a) of Section 54, for the words “with fine which may extend to five thousand rupees”, the words “with penalty may extend to twenty-five thousand rupees” shall be substituted. (6) In clause (b) of Section 54, for the words “fine”, “one” and “conviction”, the words “penalty”, “five” and “punishment” shall be substituted, respectively. (7) In clause (b) of Section 55, the words and symbol “on conviction,” shall be omitted. (8) In sub-clause (i) of Section 55, for the words “fine” and “five”, the words “penalty” and “Twenty-five” shall be substituted, respectively. (9) In sub-clause (ii) of Section 55, for the words “fine” and “ten”, the words “penalty” and “fifty” shall be substituted, respectively. (10) In Section 56, the words and symbols “, on conviction,” shall be omitted. (11) In clause (a) of Section 56, for the words “fine” and “hundred”, the words “penalty” and “thousand” shall be substituted, respectively. (12) In clause (b) of Section 56, for the words “fine” and “hundred”, the words “penalty” and “thousand” shall be substituted, respectively. 14. In the Chhattisgarh Underground Pipelines (Acquisition of Right of User in Land) Act, 2004 (No. 7 of 2004), In Section 14, for the words “punishable with simple imprisonment which may extend to six months or with fine or with both”, the words “liable for penalty of Ten thousand rupees for the first offence, in the case of second offence, punishable with simple imprisonment which may extend to six months or with fine or with both” shall be substituted.
