Penalties
The Chhattisgarh Essential Service Maintenance Act, 1979 No. 10 of 1979(1) Any person who commences a strike which is illegal under this Act or goes or remains on, or otherwise takes part in, any such strike shall be punishable with imprisonment for a term which may extend to six months, or with fine which may extend to Rs. 200, or with both. (2) Any person who instigates or incites other persons to take part in, or otherwise acts in furtherance of, a strike which is illegal under this Act shall be punishable with imprisonment for a term which may extend to one year, or with fine which may extend to Rs. 1,000, or with both. (1) Whoever contravenes, quits or attempts to contravene any of the provisions of section 5, except clause (iii) thereof, shall be punishable with imprisonment for a term which may extend to six months, or with fine which may extend to Rs. 500, or with both. (2) Whoever contravenes, quits or attempts to contravene any of the provisions of clause (iii) of section 5 shall, without prejudice to any penalty that may be leviable under any other enactment for the time being in force, be punishable with imprisonment for a term which may extend to three years and with fine which may extend to Rs. 5,000.
