The Chhattisgarh Adhyaksh tatha Upadhyaksha (Vetan tatha Bhatta) Adhiniyam, 1972
1. Short title, extent and commencement
(1) This Act may be called the Chhattisgarh Adhyaksh tatha Upadhyaksha Vetan tatha Bhatta (Sanshodhan) Adhiniyam, 2001. (2) It extends to the whole of the State of Chhattisgarh. (3) Sub-section (1) of Section 3 of the Madhya Pradesh Adhyaksh tatha Upadhyaksha Vetan tatha Bhatta Adhiniyam, 1972 shall be omitted. (4) In Section 3(3) of the Madhya Pradesh Adhyaksh tatha Upadhyaksha Vetan tatha Bhatta Adhiniyam, 1972, the words "two hundred rupees" shall be omitted and in its place "six hundred rupees" for the Speaker and "five hundred fifty rupees" for the Deputy Speaker shall be substituted. (i) This Act may be called the Chhattisgarh Adhyaksha Tatha Upadhyaksha (Vetan Tatha Bhatta) (Sanshodhan) Adhiniyam, 2002 (No. 18 of 2002). (ii) It shall come into force from the date of its publication in the Gazette. (1) This Act may be called the Chhattisgarh Adhyaksha Tatha Upadhyaksha, Neta Pratipaksha Vetan Bhatta Vidhi Sanshodhan Adhiniyam, 2004. (2) It shall come into force from the date of its publication in the Gazette. (1) This Act may be called the Chhattisgarh Adhyaksha Tatha Upadhyaksha (Vetan Tatha Bhatta) (Sanshodhan) Adhiniyam, 2013. (2) It shall come into force from the date of its publication in the Official Gazette. (1) This Act may be called the Chhattisgarh Adhyaksha Tatha Upadhyaksha (Vetan Tatha Bhatta) (Sanshodhan) Adhiniyam, 2016. (2) It shall come into force from the date of its publication in the Official Gazette.
1-A. Insertion of Section 1-A
After Section 1 of the Chhattisgarh Adhyaksha Tatha Upadhyaksha (Vetan Tatha Bhatta) Adhiniyam, 1972 (No. 27 of 1972) (hereinafter referred to as the Principal Act), the following shall be inserted, namely :-"1-A. Definitions.- In this Act, unless the context otherwise requires,- (a) "Schedule" means a Schedule appended to this Act."
2. Salary of Speaker and Deputy Speaker
The Speaker and the Deputy Speaker shall be paid a salary of Rs. 4,000 per month. In Section 4 of the Chhattisgarh Adhyaksha Tatha Upadhyaksha (Vetan Tatha Bhatta) (Sanshodhan) Adhiniyam, 1972 (No. 27 of 1972) (hereinafter referred to a Principal Act) :— (1) In sub-section (1) of Section 4, after words "of a furnished", the words "office cum" shall be substituted. (2) Explanation after sub-section (1) of Section 4 shall be omitted. (3) Sub-Section (4) of Section 4 of the Principal Act shall be omitted. (4) In sub-section (5) of Section 4 of the Principal Act after the words "repairs and maintenance" the words "and furnishing" shall be added. (5) After sub-section (5) of the Principal Act, the following explanation shall be inserted, namely :—
Explanation :— For the purposes of this Section "residence" includes the staff quarters and other building appurtenant thereto and the garden thereof and "maintenance" in relation to a residence includes the payment of local rates and taxes and the provision of electricity and water. In Section 2 of the Principal Act, for the words "of Seven Thousand rupees per mensem" the words "as specified in the Schedule" shall be substituted. For the existing Schedule of the Chhattisgarh Adhyaksha Tatha Upadhyaksha (Vetan Tatha Bhatta), Adhiniyam, 1972 (No. 27 of 1972), the following shall be substituted, namely :-

3. Sumptuary allowance, constituency allowance and daily allowance of the Speaker and Deputy Speaker
(1) The Speaker shall be paid a sumptuary allowance of Rs. 5,000 per month and the Deputy Speaker shall be paid a sumptuary allowance of Rs. 5,000 per month. (2) The Speaker and the Deputy Speaker shall be paid a constituency allowance of Rs. 8,000 per month. (3) The Speaker and the Deputy Speaker shall be paid a daily allowance at the rate of Rs. 500 per day during their tenure. In Section 4 of the Chhattisgarh Vidhan Mandal Neta Pratipaksha (Vetan Tatha Bhatta) Adhiniyam, 1980 (No. 8 of 1980),- (i) In sub-section (2) for the words "Three Thousand" the words "Five Thousand" shall be substituted, and (ii) In sub-section (3) for the words "Six Hundred" the words "Seven Hundred Sixty Seven" shall be substituted. In sub-section (2) of Section 3 for the words "Eight Thousand rupees per mensem" the words "as specified in the Schedule" shall be substituted. In sub-section (3) of Section 3 for the words "one thousand one hundred ten rupees" and "one thousand ninety rupees" the words "as specified in the Schedule" shall be inserted.
4. Residence for Speaker and Deputy Speaker
(1) The Speaker and Deputy Speaker shall be entitled to use, without payment of rent, a furnished residence in Bhopal throughout their term of office and for a period of one month immediately thereafter, and no charge shall be personally borne by the Speaker or Deputy Speaker for the maintenance of such residence. Explanation—For the purposes of this section, "residence" includes the attached staff quarters and other buildings and the garden thereof, and "maintenance" in relation to a residence includes the payment of local rates and taxes and the provision of electricity and water. (2) If the Speaker or Deputy Speaker does not avail himself of the benefit under sub-section (1), he shall be entitled to receive in lieu thereof such house rent allowance as may be equal to twenty percent of the salary payable to him under section 2. (3) In addition to the free furnished residence in Bhopal under sub-section (1), the Speaker and Deputy Speaker shall be entitled to use, free of rent, a furnished residence at such other place as the State Government may, from time to time, declare as the official residence of the Speaker or Deputy Speaker for the purposes of this Act, as long as such declaration remains in force. (4) The expenditure in respect of furnishing the residence provided under sub-section (1) to the Speaker shall be subject to a financial limit of Rs. 35,000, and for the residence provided to the Deputy Speaker, it shall be subject to a financial limit of Rs. 25,000. (5) The annual expenditure to be incurred on the maintenance, annual repairs and maintenance of the residence and garden for which provision has been made under sub-section (1) shall be subject to such financial limits as may be prescribed by the State Government by rules made in this behalf.
5. Conveyance for Speaker and Deputy Speaker
(1) The Speaker and the Deputy Speaker shall be provided with a suitable motor vehicle for their use, the purchase and maintenance of which shall be borne by the State Government in accordance with the rules made by the State Government in this behalf. (2) The State Government shall provide a motor driver (chauffeur) at public expense for each such motor vehicle, and for each such motor vehicle, for the journeys undertaken by each such motor vehicle (other than those journeys for which traveling allowance is admissible), the State Government shall provide suitable motor fuel, which shall not exceed 350 liters per month in the case of the motor vehicle provided to the Speaker, and 300 liters per month in the case of the motor vehicle provided to the Deputy Speaker.
6. Medical attendance and treatment for the Speaker and Deputy Speaker
(1) The Speaker and, as the case may be, the Speaker and Deputy Speaker's family members shall be entitled to free medical attendance and treatment to such extent and on such conditions as are applicable to the members of the All India Services and their family members under the All India Services Act, 1951 (No. 61 of 1951) and the rules made thereunder regarding medical attendance and treatment as amended from time to time. (2) As the case may be, the Speaker and Deputy Speaker, while on tour outside India in the discharge of their official duties, shall also be entitled to such medical attendance and treatment as is admissible to the head of the Indian Mission at that place.
7. Prohibition to receive salary etc. as a member and practicing any profession
The Speaker and Deputy Speaker— (a) shall not practice any profession or engage in any trade or receive any remuneration for any employment other than their duties as Speaker or Deputy Speaker during the period they receive salary and allowances for their office; (b) shall not be entitled to receive any salary or allowance as a member of the Madhya Pradesh Vidhan Sabha while they are receiving salary and allowances for their office.
8. Traveling and daily allowance for the Speaker and Deputy Speaker
(1) The Speaker and Deputy Speaker, in accordance with the rules made by the State Government in this behalf— (a) in relation to the journey from their normal place of residence, other than Bhopal, to Bhopal for the purpose of assuming office, and
