Aryabhatta Knowledge University (Amendment) Act, 2015 [Bihar Act 17,2015] AN ACT To Amend the Aryabhatta Knowledge University Act, 2008

Preamble : Whereas, in Civil Appeal No. 6831/2013 (Arising from SLP (C) 8066/2013, Dr. Ram Tawakya Singh Vs. State of Bihar and others Hon’ble Supreme Court has emphasized and need for transparent mode of selection for appointment to the post of Vice–Chancellors of the State Universities,

Whereas, Hon’ble Supreme Court has considered scope and ambit of meaningful and effective consultation between State Government and the Chancellor;

Whereas, It is expedient to provide for Uniform criteria for appointment to the post of Vice–Chancellor of the State Universities;

Whereas, in other State Universities it is interalia, stipulated that appointment of Vice– Chancellor has to be made after meaningful and effective consultation between state Government and the Chancellor.

Be it enacted by the Legislature of the State of Bihar in the sixty sixth year of Republic of India as follows:-

1. (1) This Act may be called Aryabhatta Knowledge University (Amendment) Act, 2015.
2. (2) It shall extend to the whole of the State of Bihar.
3. (3) It shall be deemed to have come into force with effect from 19th August 2013.

Aryabhatta Knowledge University Act, 2008 (Bihar Act 24, 2008 shall be substituted by the following:-

“ (2) The Vice Chancellor shall be appointed by the Chancellor in consultation with the State Government from a panel of 3-5 names recommended (the names being arranged in the alphabetical order) by a committee constituted under sub-section (3).”
