Bare Act
The Bihar Apartment Ownership Act, 2006
The Bihar Apartment Ownership Act, 2006 provides a comprehensive legal framework governing multi-storied residential and commercial apartment buildings in Bihar. It establishes that each apartment is an independent, transferable, and heritable immovable property while granting apartment owners shared, undivided rights over common areas like stairs, lifts, parking, and open spaces. The law regulates builder responsibilities, mandates complete transparency regarding land titles and approved building plans, prohibits possession without local authority completion certificates, and lays down procedures for forming owners' associations. For ordinary citizens, this law protects home buyers against developer fraud, prevents illegal construction, ensures clear title ownership, and provides structural mechanisms to resolve maintenance, registration, and succession disputes.
