Removal of difficulties

If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Official Gazette, make such provisions, not inconsistent with the provisions of this Act, as may appear to be necessary and expedient for the purpose of removing difficulties.

1. Short title, extent and commencement

1. (1) This Act may be called the Assam Public Safety (Measures) Enforcement Act, 2023.
2. (2) It extends to the whole of the state of Assam.
3. (3) It shall come into force at once. 2. Amendment of section 6 In the principal Act, in section 6, in sub-section (1), for the words, “on receipt of report from the concerned Inspector of Police having jurisdiction over the area under section 5, shall issue a show cause notice to the owner or manager or person or the persons who are running any such establishment, giving 15 days time for compliance” appearing in between the words “area shall,” and punctuation mark “.” the words, “on receipt of report from the concerned Inspector of Police regarding any violation or default, shall issue a show cause notice to the owner or manager or society or person or the persons running an establishment or owning or managing a residential building, giving twenty one days time for compliance” shall be substituted. 3. Amendment of section 7 In the principal Act, in section 7, in sub-section (1),
   • (i) in eighth line, for the words, “Commission for Police or Superintendent of Police” appearing in between the words “Jurisdictional” and “as the” the words, “Deputy Commissioner of Police or Additional Superintendent of Police” shall be substituted.
   • (ii) in eleventh line, for the words “Commissioner of Police or Superintendent of Police” appearing in between the words “The” and “as such” the words “Deputy Commissioner of Police or Additional Superintendent of Police” shall be substituted.
