Power of arrest
The Bengal Public Demands Recovery Act, 1913A certificate debtor may be arrested in execution of a certificate at any hour and on any day, except as provided in Section 47, and when so arrested, shall, as soon as practicable, be brought before the Certificate Officer; and his detention may be in the civil prison of the district in which the Certificate Officer ordering the detention exercise jurisdiction, or, where such civil prison does not afford suitable accommodation, in any other place which the State Government may appoint for the detention of persons ordered by the Civil Courts of such district to be detained: Provided that, if the certificate debtor pays the amount entered in the warrant of arrest as due under the certificate, and the cost of the arrest, to the officer arresting him, such officer shall at once release him. When property is removed to the Court it shall be kept by the nazir on his own sole responsibility in such place as may be approved by the Certificate Officer. If the property cannot, from its nature or bulk, be conveniently kept in the Court premises, or in the personal custody of the nazir, he may, subject to approval by the Certificate Officer, make such arrangements for its safe custody under his own supervision as may be most convenient and economical and the Certificate Officer may fix the remuneration to be allowed to the persons, not being officers of the Court, in whose custody the property is kept. When property is removed to the Court it shall be kept by the nazir on his own sole responsibility in such place as may be approved by the Certificate Officer.
