Statutory text
(1) Every Armed Police Court may be attended by an officer not below the rank of an Inspector of Police appointed by the Inspector-General of Police to act as a presenting officer for assisting such Court. (2) Every trail by Armed Police Court under the provision of this Act shall be deemed to be judicial proceeding within the meaning of sections 193 and 228 of the Indian Penal Code and Armed Court shall be deemed to be a Court within the meaning of Section 345 and 346 of the Criminal Procedure Code, 1973. (3) An offence committed by a member of the Armed Police may be enquired into and tried even after he ceases to be a member thereof.
