- (1) The Act may be called the Andhra Pradesh Civil Courts (Amendment) Act, 2005.
- (2) It extends to the whole of the State of Andhra Pradesh.
- (3) It shall come into force on such date as the State Government may, by notification, appoint. 2. Amendment of Section 16 In the Andhra Pradesh Civil Courts Act, 1972 (hereinafter referred to as the principal Act), in section 9, in sub-section (1), in clause (ii), in sub-clause (a), for the words “three lakhs;”, the words “five lakhs;”, shall be substituted. 1. Short title
- (1) The Act may be called the Andhra Pradesh Civil Courts (Amendment) Act, 2005.
- (2) It extends to the whole of the State of Andhra Pradesh.
- (3) It shall come into force on such date as the State Government may, by notification, appoint. 2. Amendment of section 4 In the Andhra Pradesh Civil Courts Act, 1972 (hereinafter referred to as the principal Act), in section 9, in sub-section (1), in clause (ii), in sub-clause (a), for the words “three lakhs;”, the words “five lakhs;”, shall be substituted. 3. Substitution of section 5 "substitution of section 5"
- (ii) for section 5, the following section shall be substituted, namely:- 5.
- (1) The pecuniary jurisdiction of the Chief Judge and an Additional Chief Judge shall, subject to the provisions of the Code of Civil Procedure, 1908 and the other provisions of this Act, extend to all original suits and proceedings of a civil nature including land acquisition original petitions, the amount or value of the subject matter of which exceeds rupees five lakhs.
- (2) The pecuniary jurisdiction of a Senior Civil Judge shall extend to all like suits and proceedings of a civil nature including land acquisition original petitions not otherwise exempted from his cognizance under any other law, for the time being in force, the amount or value of the subject matter of which exceeds rupees one lakh but does not exceed rupees five lakhs.
- (3) The pecuniary jurisdiction of a Junior Civil Judge shall extend to all like suits and proceedings, not otherwise exempted from his cognizance under any other law for the time being in force, the amount or value of the subject matter of which does not exceed rupees one lakh. 4. Substitution of section 16 "Substitution of section 16"
- (iii) for section 16, the following shall be substituted, namely:- "Jurisdiction of 16.
- (1) The pecuniary jurisdiction of a District Judge, shall subject to the provisions of the Code of Civil Procedure, 1908 and the other provisions of this Act, extend to all original suits and proceedings of a Civil nature including Land Acquisition original petitions, the amount or value of the subject matter of which exceeds rupees five lakhs.
- (2) The pecuniary jurisdiction of a Senior Civil Judge shall extend to all like suits ar.d proceedings of a Civil nature including land acquisition original petitions not otherwise exempted from his cognizance under any other law for the time being in force, the amount or value of the subject matter of which exceeds rupees one lakh but does not exceed rupees five lakhs.
- (3) The pecuniary jurisdiction of a Senior Civil Judge shall extend to all like suits and proceedings, not otherwise exempted from his cognizance under any other law for the time being in force, the amount or value of the subject matter of which does not exceed rupees one lakh." 5. Amendment of section 28
- (iv) in section 28 for the words "the Court of Senior Subordinate Judge" the words "the Principal Senior Civil Judge" shall be substituted; 6. Amendment of section 33
- (v) in section 33 for the words "the Court of Munsif" the words "the Court of Junior Civil Judge" shall be substituted;
