Chapter IV PENALTIES

All members of the management committee of the School shall be jointly and severally responsible for compliance of the provisions of the Act.

If the school management Committee violates any provision of this Act or the rules made thereunder, every member of the school management committee on being convicted by a competent Court shall-

1. (a) For first violation be liable for a fine up to Rs 50,000 or twice the amount charged in excess of the fees fixed by the competent committee under this Act, whichever is more;
2. (b) For each subsequent violation be liable for a fine of Rs 1,00,000 or four times the amount charged in excess of the fees fixed by the competent committee under this Act, whichever is more;
3. (c) The trial of cases under this section will be done by a competent court. The provisions of Code of Criminal Procedure, 1973 (2 of 1974) shall be applicable in respect of trial, appeal etc.: Provided that a Court shall take cognizance of under this Section only on a written complaint of District Education Officer and not otherwise.
